Regulation of provision of services


1 Introduction

1.1 This Regulation of provision of services (hereinafter — Regulation) regulates provision of services of reservation and sale of air tickets through the www.avia.md website, property of Solei-Turism S.R.L. company – hereinafter the Agency.

1.2 This Regulation may be amended, but the website shall always display the latest and actualized version, and its provisions shall apply to the services, provided within its term of action.

1.3 Any visit to, view of, registration on the website, and reservation and purchase of air tickets using the website means that you are acquainted with this Regulation, understand its content and accept its provisions.





2 Description of services

2.1 Through the www.avia.md website the Agency offers a dynamic online database for reservation and purchase of air tickets, with the help of which, upon an inquiry, completed by the client in a special reservation form, the website displays all flight options and prices available at the time of inquiry.

2.2 The information displayed on our website upon the client’s inquiry as to flights and prices is the information of airlines, operating the inquired flights.

2.3 Our website is not and shall not be regarded as recommendation or guarantee of (quality, service level or rating) of any mentioned flight option.

2.4 For each particular inquiry, at any particular moment the dynamic database generates an option valid at the moment of inquiry, corresponding to the actual situation pertaining to available seats on the inquired flight.

2.5 Presentation of flight options at the client’s request on the www.avia.md web site is the agency’s offer and client’s payment for one or another flight option represents the client’s acceptance to conclude an air ticket sale agreement with the Agency and an agreement of passenger and luggage transport with the airline. From the moment of payment for the air ticket according to the offer selected by the client the air ticket sale agreement between the client and the Agency and the passenger transport agreement between the client and the airline are considered concluded. The itinerary receipt, sent to the email address, provided by the client when selecting and paying for the air ticket, represents a passing document, confirming the fact of conclusion of the air ticket sale agreement and the transport agreement.

2.6 Buying an air ticket through our website the client enters into direct (binding) contractual relations with the Agency as regards sale of air tickets and with the airline as regards air transport. The Agency is entitled to sell air tickets under various agreements pursuant to which it is the agent of airlines operating flights or the agent of their legal representatives, as well as under agreements with one of the Global Air Ticket Distribution Systems (GDS – Global Distribution System).

2.7 Upon payment by the client for an air ticket through the system of payment collection, maintained by the website, the information pertaining to the reservation for the flight is directed to a Global distribution system (Global Distribution System, hereinafter GDS) and becomes accessible to the airline, operating the flight and to the airport of departure.

2.8 The client receives an itinerary receipt to the email, provided when buying the electronic air ticket. The said itinerary receipt provides all information, necessary for the client’s access to the flight.

3 Tariffs and prices

3.1 Upon the inquiry, completed by the client in the search form of the website, the site displays all flight options accessible at the time of inquiry and prices for air tickets according to destinations that you select.

3.2 The price for each flight option is final and no additional payments are required.

3.3 Please pay attention to the fact that for some tariffs or special offers no annulments or changes may be made. To get acquainted with the exact rules of the tariff of the air ticket that you booked, check the tariff rules provided for it. Tariff rules are indicated at the moment of display of any flight on the www.avia.md website in a special blank of the air ticket reservation form. Additionally, brief information on tariff rules is obligatorily provided in the itinerary receipt, received by the client at his email address. If you need to clarify any information – contact the air tickets sales agent.

3.4 Paying for an air ticket means that you are acquainted with all tariff conditions and accept them.

4 Confidentiality

4.1 The Agency maintains high ethical standards, your interests and you personal data confidentiality. Except for cases, required and provided by the effective legislation, we shall not provide any of your personal data to third parties without your consent.

5 Procedure of payment for air tickets with a bank card

5.1 Order form. Using the air ticket reservation system, the client fills in the order form with the necessary flight option and selects the manner of payment for it with a bank card.

5.2 Payment form. The www.avia.md website redirects the client to the Victoriabank secure processing center payment form, connected to the closed networks of Visa, MasterCard etc. The Victoriabank bank is also the acquirer bank (acquirer), processing credit card payments for the www.avia.md website.

5.2.1 The “Secure Sockets Layer (SSL)” standard industrial technology is used for protection and encryption of sent data.

5.3 Victoriabank. The Victoriabank processing center verifies the status and parameters of the www.avia.md website, and performs a verification of the completed inquiry as regards its conformity to set requirements and systemic restrictions and conveys the inquiry for authorization to the Victoriabank acquiring center to obtain payment authorization.

5.3.1 Receiving a request to authorize a card transaction, used by the client of the www.avia.md website, the Victoriabank acquiring center conveys it into the corresponding international payment system (Visa, MasterCard etc.), hereinafter – payment system.

5.4 The payment system identifies the issuing bank, which issued the buyer’s bank card, verifies availability of money on it, and conveys the authorization request for authorization to the Victoriabank processing center.

5.5 The issuing bank of the client’s card confirms its payment capacity, authorizes buyer’s payment and reserves the necessary amount for the air ticket purchase. The cash availability confirmation and authorization reach Victoriabank.

5.6 Victoriabank. The Victoriabank processing center conveys to the www.avia.md website the authorization’s positive result, and the latter at its turn makes the flight reservation for the client in the reservation system, which conducts air ticket selection and reservation and informs the buyer that the order was successfully paid.

5.7 Air ticket. The www.avia.md website issues an itinerary receipt of the electronic air ticket and sends it to the email address provided by the client upon registration. To register for a flight in the departure airport it will be sufficient to present the passenger’s passport, in the name of whom the electronic air ticket was issued. To accelerate the registration procedure at the airport the client may also present the itinerary receipt.

5.8 If you need more information regarding payment for air tickets with bank cards you may appeal to the Agency or the „Victoriabank” S.A. commercial bank.

6 Procedure of payment through wire transfer to the Agency’s current

6.1 Order form. The client using the air ticket reservation system fills in the order form the necessary flight option and selects payment via wire transfer to the bank account of the Agency.

6.2 Payment form. An invoice is sent to the email address indicated by the client in the process of reservation of the air ticket, providing the order’s code, flight destination, air ticket price, passenger’s data. The fact of payment and the payment document data are brought by the client to the knowledge of the operator, who had sent the invoice. After the money reach the current account of the Agency, the operator issues an air ticket and sends it to the client.

7 Procedure of payment in cash in banks all over the territory of the Republic of Moldova

7.1 Order form. The client using the air ticket reservation system fills in the order form the necessary flight option and selects payment in cash in banks all over the territory of the Republic of Moldova.

7.2 An invoice is sent to the email address provided by the client in the process of reservation of the air ticket, providing the order’s code, flight destination, air ticket price, passenger’s data.

7.3 Such an invoice may be paid in any branch of any of the following banks in Moldova: Moldova-Agroindbank, Moldindconbank, Victoriabank, Mobiasbanca, as well as in any branch of the S.E. Posta Moldovei.

7.4 Information regarding payment automatically passes from the bank to the www.avia.md website and the system issues an electronic air ticket, the data of which are sent to the email address provided by the client in the process of reservation of the air ticket.

8 Procedure of payment in cash in the office

8.1 Order form. The client using the air ticket reservation system fills in the order form the necessary flight option and selects payment in cash in the Agency’s office.

8.2 An invoice is sent to the email address provided by the client in the process of reservation of the air ticket, providing the order’s code, flight destination, air ticket price, passenger’s data. Such an invoice may be paid in any of the Agency’s offices in Chisinau. Upon payment the operator issues the air ticket and hands to the client all necessary documents.


9 Order annulment procedure

9.1 When you reserve and buy an air ticket through the Agency’s website (www.avia.md), you accept and consent to the procedure of air ticket annulment or change of flight date, to the rules, applicable to the flight and to the rules of provision of services through the www.avia.md website.

9.2 The general provisions of all aforementioned rules are displayed on our website, or the website contains links to third party websites, whose rules, apply to the service purchased through our website. Likewise, during order completion, the Agency’s website pages display information on the rules of each purchased air ticket tariff.

9.3 Electronic reservation confirmation (itinerary receipt) also contains the rules pertaining to your air ticket tariff.

9.4 Please pay attention that for some tariffs and special offers no annulments and changes may be made. We recommend you to study carefully the tariff description and special rules before you make a reservation.

9.5 If you want to change or annul your order, look at the electronic reservation confirmation and follow the instructions provided in it. Please pay attention that you may be charged with an additional fee in accordance with the tariff rules pertaining to annulment or change of flight date. We recommend you to carefully look through the rules before you make the reservation.

9.6 Before you pay for the air ticket, read this Regulation and the information on the tariff rules. You may address all the questions arising in connection with the flight and tariff rules of the ticket that you buy to the Agency’s sales agents at the following telephone number +373 22 890-890+373 22 890-890 before you pay for the air ticket.

9.7 Payment for the air ticket means that you are acquainted with the rules.

10 Communication

10.1 Reserving an air ticket, you accept to receive at least: 1. an electronic message, which we will send to you after you pay for the air ticket, and which will contain information on the flight, and 2. telephone calls, if necessary to clarify payment details or bring to you urgent and important information, pertaining to the flight.

10.2 Except for the electronic reservation confirmation and aforementioned telephone calls we shall not call you and shall not later send you notifications, emails and messages (required or not required), and shall not call you, unless it is necessary or unless you specially consent to it.

11 Liability

11.1 Hereinafter, we inform you of certain liability aspects additional to the ones provided in the Air ticket sale agreement and the Transport agreement.

11.2 According to the limitations, set in this Regulation of provision of services, the Agency is liable only for direct damages, actually caused or as a consequence of actual non-performance of our obligations when we provide services (sell air tickets) and only within the limit of the commission fee collected by the Agency from the airline out of the price of your order, shown in the electronic reservation confirmation.

11.3 Our company shall not be liable in the following cases without limitation:

11.3.1 In case of application to you of fines or other penalties at preparation for the flight or in the process of pursuing flight connected procedures or in the flight process.

11.3.2 For any loss or damage of products, income, profit, contract, damage or prejudice, caused to the name or reputation, and denial of damage compensation action, connected to the flight with the ticket bought through the Agency’s website.

11.3.3 For any impreciseness, pertaining to descriptive information (including prices and air ticket availability), displayed on the website.

11.3.4 In case of inaccurate provision of passenger personal data and / or flight details by the client upon air ticket reservation.

11.3.5 In case of use for payment for air tickets through our website of an invalid or compromised bank card upon submission of damage compensation claims and requests by the card owner. In this case the whole liability shall be incurred by the passenger, who received air transport services, including for compensation of damages suffered by the Agency as a result of such a transaction.

11.3.6 For services and products, provided by third parties (airlines, airports, taxies, etc.).

11.3.7 For any defects, losses or damages, suffered or paid by you and appeared in connection or as a result of use, impossibility to use or interruptions of operation of our website.

11.3.8 For any injury, decease, damage to property or other damages, losses or defects, suffered as a result of (legislative) acts, errors, violations, (gross) negligence, intentional illegal actions, mistakes, non-performance, misinterpretation, non-performance of civil liability or direct obligations (fully or partially) by third parties, including any annulment, strike, force major events or other uncontrolled events, connected to the flight with the air ticket purchased using the Agency’s website.

12 Other provisions

12.1 If not agreed otherwise, the information and software, necessary for provision of our services and used on our website and respectively the copyrights and patrimonial rights in them, as intellectual property, are owned by the Agency or its suppliers.

12.2 This Regulation and the provision of our services are regulated by the effective legislation of the Republic of Moldova and the Rules of the International Air Transport Association (IATA – International Air Transport Association).

12.3 All disputes, arising in connection with this Regulation, the air ticket sale agreement, the transport agreement and with provision of our services, shall be solved in negotiations or in the courts of the Republic of Moldova, if the Agency does not instruct otherwise.

12.4 All services, offered by / through www.avia.md are provided by the Agency in accordance with the legislation of the Republic of Moldova.
